By using Lend Certified ("the site"), you agree to these terms. If you don't agree, please don't use the site.

Please note: these terms include a binding arbitration provision and a class-action waiver (see "Dispute resolution" below) that affect how disputes between you and Lend Certified are resolved.

What Lend Certified is

Lend Certified is an informational directory. Profile data is sourced from public NMLS Consumer Access records and from information brokers provide themselves. We display this data to help real estate professionals and buyers make informed decisions.

Data accuracy disclaimer: We do not independently verify every data point. NMLS data may be delayed or contain errors. Endorsements are self-reported by third parties and are not verified. Do not rely solely on Lend Certified when making financial or transaction decisions.

Broker accounts

Brokers may claim and edit their own profiles. By claiming a profile you attest that:

Submitting false information may result in removal from the platform and may be reported to the NMLS and relevant state licensing authorities.

Endorsements

Endorsements are submitted by third parties (agents, title reps, TCs, clients). Lend Certified does not verify endorsers' identities or the accuracy of their responses. Endorsements are limited to one per IP address per broker profile to reduce spam.

We reserve the right to remove endorsements that appear fraudulent or that violate these terms.

No guarantee or endorsement

Lend Certified does not guarantee, warrant, or endorse the performance, conduct, advice, or outcomes of any mortgage broker listed on the site. A listing, a profile, or any recommendation does not constitute our endorsement of a broker or a guarantee of results.

Recommendations and endorsements are the opinions of the individual agents and other third parties who submit them — they are not the opinions of Lend Certified and do not reflect any verification or vetting by us. We do not control, and are not responsible for, the conduct of any broker or the substance of any third-party recommendation.

Lend Certified is not a party to any transaction, agreement, or relationship between you and a broker. We are not a mortgage broker, lender, or financial adviser, and nothing on the site is financial, lending, or legal advice. Always do your own due diligence and confirm a broker's license status directly through NMLS Consumer Access before engaging them.

Prohibited conduct

Disputes, corrections, and removal

If you believe a profile contains incorrect information, or you want to dispute an endorsement or report content you believe is inaccurate, unlawful, or infringing, use the Submit a request form. We review every request and respond.

Brokers (or their authorized representatives) may request removal of a profile at any time using the same Submit a request form (choose "Remove a profile"). We process verified removal requests promptly, usually within 1–2 business days. Removal is a reviewed request rather than an instant deletion, so that one person cannot delist another broker's profile.

Copyright complaints (DMCA)

We respect intellectual property rights and respond to notices that comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the site infringes your copyright, submit a notice through the Submit a request form that includes: (1) identification of the copyrighted work you claim is infringed; (2) identification of the allegedly infringing material and its location on the site (URL); (3) your name, mailing address, telephone number, and email address; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature.

If material you posted was removed in response to a notice, you may submit a counter-notice through the same form containing the elements described in 17 U.S.C. § 512(g)(3). We may restore the material if the original complainant does not file a court action within the statutory period. We terminate the accounts of repeat infringers where appropriate.

Indemnification

You agree to defend, indemnify, and hold harmless Lend Certified and its owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content or information you submit to the site, including profile information and endorsements; (b) your use or misuse of the site; (c) your violation of these terms; or (d) your violation of any law or of the rights of a third party, including intellectual-property, publicity, and privacy rights. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

Disclaimer of warranties

Lend Certified is provided "as is" and "as available," without warranties of any kind, express or implied — including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any data on the site is accurate, complete, or current.

Limitation of liability

To the maximum extent permitted by law, Lend Certified and its owners, operators, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost business, lost data, or reputational harm — arising out of or related to your use of (or inability to use) the site, or your reliance on any information displayed on it, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the site or these terms will not exceed the greater of (a) the total amount you paid us for use of the site in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the above may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Dispute resolution — binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before filing any claim against Lend Certified, you agree to first contact us through the Submit a request form with a description of the dispute and give us 60 days to resolve it informally. Most concerns can be resolved this way.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these terms or the site that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this provision. Judgment on the arbitration award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court for actual or threatened infringement or misuse of intellectual property.

Class-action waiver. You and Lend Certified each agree that disputes will be brought only on an individual basis — not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Opt-out. You may opt out of this arbitration provision by notifying us through the Submit a request form within 30 days of first accepting these terms, stating your name and that you wish to opt out of arbitration. Opting out does not affect any other part of these terms.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the waiver remains in effect for all other claims. If any other part of this section is found unenforceable, the rest remains in effect.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Where a claim proceeds in court rather than arbitration, you and Lend Certified consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California.

Changes

We may update these terms. If we make material changes, we will update the effective date at the top of this page. Continued use of the site after changes constitutes acceptance of the updated terms.
